PREAMBLE

The organization of Jama'at-e-Islami is founded on the Islamic Principles of Consultation. These principles are permanent, yet, the institutions and organizational structures formed under these principles undergo changes according to varying circumstances. Consequently, with expansion in the Jama'at's organization, additions, amendments and changes have also been made in Jama'at's Constitution. So a brief account of the evolutionary stages of Jama'at's constitution has been given in Appendix 5. The Council's interpretations and explanations of a few articles of the constitution are given Appendix 4, for better comprehension.

The present edition of Jama'at's Constitution includes the amendments until 29th December 2019.

Note: This is a fair rendering in English of the text and spirit of the Constitution, yet for all legal and practical purposes the original Urdu Version shall be referred to.

Part I Name, Mission, Prerequisites and Obligations of Membership

Article 1: The name of this party shall be the "Jama'at-e-Islami Pakistan", and the name of this constitution shall be the "Constitution of the Jama'at-e-Islami Pakistan".

Article 2: This Constitution shall come into force from the 1st day of June, 1957, corresponding to 2 Dhul-Qa'dah 1376 AH.¹

Article 3: The fundamental creed of Jama'at-e-Islami shall be La ilaha ill-Allah Muhammad ur Rasul Ullah. There is no god but Allah and Muhammad is the Messenger of Allah.

Explanation: The first part of this creed, i.e. 'There is no god but Allah' means that the earth and heaven and of all that is in the earth and in heaven, Allah alone is the Creator, Sustainer, Lord, and such a Sovereign who is the Maker and the Lawgiver. No one associates, in any of these attributes, in any capacity, with Him.

Knowing and admitting this fact, it becomes imperative that:

(1)Man should not consider anyone else save Allah as Guardian and Master, Disposer of Affairs and Guarantor, Ever Responsive and All-hearing, the Succour and Helper, because none else even possesses any power.

See Appendix 5, for the amendments made to the Constitution after June 1, 1957, which are now a part of it.

(2)Not to consider anyone else as Benefactor and Distresser. not to adopt Taqwa (piety) or be afraid of none, not to Trust and reliance on none, not to vest hope in none, save Allah because all powers are vested in Him.

(3)Not to supplicate anyone, seek refuge with none, and call none else for help save Allah. Not to think even that someone can be so influential and dominant in God’s Administration that his intercession can change Allah’s Will, because all are powerless subjects in Allah’s empire, be they angels, prophets, or saints.

(4)Not to bow down head before anyone, worship none, vow to none, and not to think of any act as the polytheists do about their deities, because Allah alone has the right to be worshipped.

(5)Not to recognise anyone save Allah as King, Lord of all dominion, the highest Mighty in Power, not to look upon none as authorized to command and interdict on his own, not to acknowledge anyone as permanent Lawgiver and Lawmaker in own right, and refuse to accept all those submissions that do not conform to Allah’s obedience and abide by His Law, because Allah alone is the valid Lord of His Universe and legitimate Sovereign of His Creation. None else has any right to Lordship and Sovereignty.

Moreover, the acceptance of this creed obligates that:

(6)Man should surrender his own liberty and autonomy; renunciate devotion to his own desires, and instead be slave of Allah whom he has accepted as God.

(7)Not to think himself owner of anything and having authority on it, but understand that everything even his own life, his organs as well as his intellectual and physical abilities belong to Allah and are entrusted from Him.

(8)Regard himself as responsible and accountable before Allah and always keep in view this fact that he has to render the account for the use of all his potentials, his conduct and consumption before Allah on the Day of Judgement.

(9)The criterion of his inclination and disinclination should be what Allah loves and does not love.(10)The objective of all his efforts and struggle and the axis of his entire life should be the attainment of Allah's pleasure and His proximity.(11)Follow Allah's Guidance only as the guidance in every sphere of his life: in ethics, conduct, society and civilization, economy and politics, and reject every way and rule that is against Allah's Shari'ah.

The second part of this creed, i.e., Muhammad is Allah's Messenger means that, the authentic guidance and Code of Law sent to human beings living on earth, by the Lord of Universe through the last Prophet, whom He appointed to establish a perfect example in accordance with that code by following it, is Muhammad (PBUH).

Knowing and admitting this reality, it becomes imperative that:

(1)Man should accept, without the least hesitation, all that teaching and all that guidance which is proved on the authority of Muhammad (PBUH).

(2)To induce him, to follow an order or to refrain from following certain other way, it will only be sufficient that this order or prohibition is proved from Allah's Messenger. No other reason should influence his obedience.

(3)Not to accept leadership and guidance of anyone permanent in nature except that of the Prophet Muhammad (PBUH). The following of other men should be subject to the Book of Allah and the Sunnah of His Prophet, and not independent of these.

(4)Embrace the Book of Allah and the Sunnah of His Prophet as the ultimate reason, authority, and reference in all matters of his life; adopt a thought or belief or rule that is in accordance with the Book and the Sunnah, and reject whatever opposed to these; and refer to the same source of guidance to solve problems that require solution.

(5)Free his heart from all kind of prejudices whether they are personal or familial, tribal or racial, nationalistic and patriotic, or sectarian and factional. He must not be so overwhelmed by love for or devotion to someone that it overcomes the love and devotion for the truth brought by the Prophet of Allah or confronts it.

(6)Apart from the Prophet of Allah, regard no one as the criterion of the Truth; consider not anyone above criticism, not to be subject to mental slavery of anyone, appraise and evaluate everyone by the same perfect criterion set by Allah, and whoever qualifies in whatever place in terms of that criterion should be kept in the same place.

(7)Not to recognise such a status to any other human being born after Muhammd (PBUH) that believing in him or not believing in him determines one’s Kufr (disbelief) and Iman (faith).

The Mission

Article 4: The mission of the Jama’at-e-Islami and the objective of all its efforts and struggle, practically, shall be the establishment of Divine Government or Islamic Way of Life (Iqamat-e-Deen) and in reality, achieving Allah’s pleasure and success in the Hereafter.

Explanation: In the term of this Jama’at, the three words ‘Al-Deen’ (the Religion), ‘Divine Government’ and ‘Islamic Way of Life’ are synonyms. The way Qur’an states its sense through the words Iqamat-al-Din (establishing the Religion) this Jama’at uses, in the same sense, the terms of ‘Divine Government’ or ‘Islamic way of Life’ in its own language. These three mean the same to it, and that is, the man having discretion in whatever sphere of human life must accept with eagerness Allah’s De Facto Government in the same way as every particle of the Universe in the circle of compulsion is following willingly or unwillingly His Cosmogonic Government. The way of life that emerges as a result of bowing down to Allah’s this De Facto Government that is ‘al-Deen’, ‘Divine Government, or ‘Islamic Way of Life’.

The ‘Establishment of Deen’ does not mean establishing some particular part of it, rather establishing Deen in its entirety, whether it deals with individual life or collective life; or it pertains to prayers, fasting, Hajj and Zakat or economy, society, civilization and politics. No part of Islam is unnecessary.

The whole Islam is necessary. It is incumbent upon a Believer to strive for establishing this whole Islam without any analysis and division. The part of it that is related to individuals' own life, every believer should observe it in his life on his own, and the part that cannot be formed without collective struggle, the believers should arrange together party discipline and endeavour for it.

Although the believer's real purpose is to seek Allah's pleasure and success in the Hereafter, but the realization of this purpose is not possible without trying to establish Allah's Deen in this world. Therefore, a believer's practical mission is the establishment of Deen, and real mission is Allah's pleasure which will be attained through efforts for establishing Deen.

Article 5: The Jama'at's permanent procedure in this regard shall be as follows:(1)It shall ascertain, before deciding on any matter or taking any step, that what the directive of Allah and His Prophet is. All other things shall keep in view as secondary only to the extent, which Islam permits.(2)To realize its objective and mission the Jama'at shall never use such ways and means that are against veracity and honesty or may cause 'mischief on the earth'.(3)For the reform and revolution in view, the Jama'at shall use democratic and constitutional means, i.e. to reform the minds and characters through preaching, urging, and propagation of thought; and to form public opinion for accepting the changes before Jama'at.(4)Jama'at shall not struggle for the realisation of its mission on the pattern of secret movements, but it shall be open and public.

Article 6: Every mature and sensible person (whether man or woman, belonging to any caste, community or race) can become a member of this Jama'at, provided that:(1)After understanding the Jam'at's creed along with its explanation, he/she bears witness that the same is also his/her creed.

(2)After understanding the Jam'at's mission along with its explanation, he/she declares that the same is also his/her mission.(3)After studying the constitution, he/she commits that he/she shall bind him/herself to the Jama'at's discipline in accordance with the constitution.(4)He/she abides by the duties imposed by the Shari'ah and avoids the major sins.(5)Not to have any source of income that falls in the category of illegitimate earnings e.g., interest (usury), wine, adultery, dance and music, false witness, bribery, breach of trust, gambling, etc.(6)If he/she has in possession such a money, (or property) that came by forbidden means, or that includes the usurped rights of the deserving, then he/she shall withdraw from it and return to the deserving their due.Explanation:Such an action shall be taken only when the rightful owners are known and the property in which their rights have been usurped are known and determined too. Otherwise, repentance and reform of conduct in the future will suffice.(7)Not associated with such a party or institution, whose principles and objectives are contrary to the creed, mission and procedure of the Jma'at-e-Islami.(8)The Jama'at's cadre satisfies that he/she qualifies for the Jama'at's membership.

Article 7In accordance with the prerequisites stated above the procedure for joining the Jama'at shall be that, the applicant shall confess, before the President (Ameer) or before his nominated/ authorized person, that,Firstly, he/she has understood completely the creed of the Jama'at along with its explanation and having understood it, bears witness now with full sense of responsibility that there is no god but Allah, Who is One, He has no associate, and Muhammad is the Messenger of Allah.Secondly, he/she has understood completely the mission of the Jama'at along with its explanation and having understood it, declares that establishing Allah's Deen in this world, is the mission of his/her life

and he/she is joining Jama'at-e-Islami purely for Allah's sake to strive for the attainment of this mission; and he/she has no other objective in view in this work except Allah's pleasure and success in the Hereafter.Thirdly, he/she has also fully understood the Jama'at's constitution and pledges that he/she would follow the Jama'at's system according to this constitution.

Obligations of Women Members Article 8: After joining the Jama'at, the changes that every member would have to bring gradually in his/her life are as follows:

(1)Acquiring at least that much knowledge of Deen that is necessary to differentiate between Islam and non-Islam and to acquaint with the ‘bounds set by Allah’ (Hudud-ul-Allah).(2)Molding their own point of view, thought, and action according to the teachings of the Qur’an and the Sunnah, adapting the objective of their own life, criteria of their liking and esteem, and axis of their loyalties conform to Allah’s pleasure, and breaking their egoism and idol of self in submission to the commandment of the Lord.(3)Purifying heart from all the practices of ignorance which are against the Book of Allah and the Sunnah of Allah’s Messenger, and trying utmost to adopt his inward and outward alike according to Shari’ah commandments.(4)Purifying its heart from such prejudices and interests, and its life from quarrels and altercations which are based on egotism and worldly pursuits and that have no other significance in Islam.(5)Disengaging dealings and cordial relations with wicked, mischievous and people heedless of Allah, and joining the righteous.(6)To establish its dealings on rightfulness, justice, God-fearing and steady Truth-seeking.(7)Concentrating its efforts and struggle on the mission of establishing Deen and excluding itself from, except the real necessities of its life, all those activities not leading towards this mission.

Obligations of Women Members

Explanation: It is not necessary that all these changes should be at their best in all persons, but everyone would try to attain perfection in this regard. Because being defective or perfect with respect to these changes would determine the status of every person in "Jama'at-e-Islami.

Article 9: It shall be obligatory on every member of the Jama'at to disseminate, in its circle of acquaintance and as far as it can reach, to the people generally, the creed of the Jama'at and mission (explained in the articles 3 and 4), and persuade those who accept it for an organized struggle and invite those who are ready to struggle, to join the system of Jama't-e-Islami.

Explanation: If any person, in spite of, expressing agreement with the mission, procedure, programme and the organisation of the Jama'at, is unwilling to carry out for any reason the responsibilities of membership, then he should be induced to join the Jama'at's circle of supporters so that he cooperates with the Jama'at to the extent possible for him in the struggle of establishing Deen.

Article 10: The articles 8, 9 with all details shall apply on those women, in their sphere of activity, joining the Jama'at, also, as the member of Jama'at at the duties of a woman shall be as follows:(1)Communicate Jama'at's creed and mission to her family and the circle of acquaintance.(2)Preach it to her husband, parents, brothers, sisters and other members of the family.(3)Try to kindle the light of faith in her children's hearts.(4)If her husband or son or father and brother join the Jama'at, she should encourage them with her enduring companionship, and help to the extent possible, in their service to the Jama'at's mission, and face, with patience and constancy, the events of adversity.(5)If her husband or guardians are victims of ignorance, earn by unlawful means or commit sins then she should try with patience to correct them, try to protect her from their unlawful earning and errors, and refuse to obey such of their orders that tantamount to disobedience of Allah and the Messenger.

Part II

Nature of Jama'at's System and attributes of those who run it

Article 11: The system of Jama'at-e-Islami Pakistan shall be consultative, and the organization shall consist of Central and various regional disciplines.

Explanation: The system being consultative means that the appointment or dismissal of the President and members of the Council shall be through the vote of the members of the Jama'at, and all the affairs of the Jama'at shall be conducted in the light of Islamic teachings with mutual consultation.

Article 12: In this Jama'at, the status and position of a person shall not be evaluated on the basis of his/her pedigree, academic qualification and financial condition but shall be according to the commitment that he maintains with Allah, and His Prophet and His Deen; and the Jama'at shall ascertain such an attachment through the sacrifices he would make in the way of Allah's Deen: denial of the demands of self, and physical and material sacrifices.

Explanation: The aim of this article is to present before the members that standard against which they may try and asses the workers of their Jama'at and form an opinion as to what kind of people should be in the fore and what kind of people should be kept in the rear of the Jama'at's disciplines. As far as the rights of membership are concerned, all the members of the Jama'at are equal; but moral distinction and leadership role and claim to the responsible position shall not be based on one's family nobility, or fame and reputation, or wealth, or academic qualifications, but on one's observance of the commandments of Allah and His Prophet, one's understanding of Deen and its practice, one's ability to run the affairs of the Jama'at and to offer sacrifices of his time, labour, and material resources for the cause of Jama'at.

Those who fulfill the conditions of membership according to Article 6, but make no particular effort towards their own perfection according to Article 8, nor show any special enthusiasm in the affairs that

the Jama'at strives for, may continue as members of the Jama'at but cannot be given leadership role or allowed to hold positions of responsibility. If such a person is given a status in consideration of his other merits, it will be considered violation of the Constitution.

Attribute of the Jama'at's PresidentArticle 13: The following attributes shall be kept in view for the election and appointment of the President (central or of any subordinate level):(1)That he should not be a candidate for Presidency, nor should there be any such thing as may be showing that he has been seeking or striving for the post.(2)That the Jama'at members have confidence in his piety (taqwa), knowledge of the Book and Sunnah, trustworthiness and honesty, divine insight, understanding of Islamic movement, firmness of opinion, thoughtfulness, decision-making ability, perseverance and steadfastness in the way of Allah, and his ability to run the Jama'at discipline.(3)That, for a Provincial or a Divisional President, he should have been the member of Jama'at for at least two years, and for a District and a Local President, for at least one year, unless the President considers it necessary to wave this condition.

Attribute of the members of the CouncilsArticle 14: The following attributes shall be kept in view for membership of the Council (central or subordinate):(1)That he should not himself be a candidate for membership of the Council, nor there should be any such thing as may be showing that he has been seeking or striving for the membership.(2)That, he should be distinguished among other members with respect to his knowledge and piety, trustworthiness, understanding and insight, perseverance and steadfastness in the way of Allah and dependability in missionary services.

Part III

The Central Organisation

General Assembly, the President, the Central Council, Working Committee, Secretary General, Directors of Central Departments

Article 15: The central system of Jama'at-e-Islami Pakistan shall comprise of the following components:(1)General Assembly of the Jama'at-e-Islami Pakistan (Article 16).(2)The President, (Article 17), and his appointed Vice President(s), if any, (Article 19) (4)(c).(3)The Central Council (Article 21).(4)Central Working Committee (Article 19) (4a), (Article 34).(5)Secretary General (Article 35).(6)Directors of Central Departments (Article19) (4)(h), (Article 37).(7)Election Commission (Article 37-a)(8)Election Tribunal (Article 37-b)

1 - General Assembly

Article 16: (1) The ultimate powers in all matters of Jama'at-e-Islami Pakistan shall vest in the General Assembly.(2)The Central Council or the President can convene the General Assembly whenever they deem it necessary according to the need of the Jama'at, or Councils of five or more of the organizational circles demand for this by passing a regular resolution, it will be necessary to convene the Assembly within a reasonable time.

(3)The definition of General Assembly may also include an Assembly to which all the members may not be invited for participation but according to the recommendation of the Central Council some select delegates from amongst the Jama’at members from every organizational province, division or district may be summoned.

2 – The President (Ameer-e-Jamaat-e-Islami Pakistan)

Article 17(1)There shall be a President of the Jama’at-e-Islami Pakistan, whose status will not be that of the Leader of the Faithful {Ameer al-Mo’mineen, (as this title is generally known)} but only that of the President of this Jama’at. The Jama’at members shall be bound to obey him in the rightful (Ma’ruf).(2)The Jama’at’s call shall be to its creed and objective, not to the person and the office of the President.(3)The members of the Jama’at shall make the appointment of the President by direct vote and simple majority shall be decisive in this vote.(3a)At least three months ahead of the expiry of the President’s term of office, the Election Commission would initiate the process of President’s Election(4)The election of the President shall be for five years, and Jama’at members may elect the same person more than once.(5)Should they so desire before the incumbent’s term ends. But if this could not happen, the incumbent would continue in office till the successor’s assuming charge of office, but this duration would not be more three months.(6)If the office of the President falls vacant for any reason like resignation or dismissal and it is not possible to hold an election for a new President, the Central Council shall elect a than President

temporarily. In this election simple majority of the vote of the Council will be decisive. This temporary arrangement will be for six months at the most and it shall be necessary to have a new President elected by the members before the lapse of this period.

(7)If it becomes inescapable for the President to temporarily abdicate his duties, he will appoint someone from among the members of the Council to act in his place. The period of such an appointment shall not be more than a year and, in case of exceeding six months, the appointment shall have to be ratified by the Central Council.

Article 18: Before assuming office, it shall be imperative for the President (whether interim or permanent, or acting) to take oath of office as given in Appendix I of this constitution. The President can take this oath at General Assembly, or at a session of the Central Council, or at a local assembly of members, as per situation.

The Oath

Article 19: (1)The ultimate responsibility for running the Jama'at's organization and the 'Movement' shall be of the President and he shall be responsible to the Council and members of the Jama'at.

(2)The President shall formulate Jama'at's policies and take decisions on important issues in consultation with the Central Council.

Duties and Powers of the President

(3)It shall be the duty of the President:(a)To give priority to obedience and loyalty to Allah and His Prophet (PBUH) over the rest.(b)To consider the service of Jama'at's objective and mission his foremost obligation.(c)To give preference to Jama'at's interests and the obligations for its work over his own person and personal benefits.(d)To decide among the members of the Jama'at with justice and honesty.(e)To protect what is entrusted to him by the Jama'at.(f)To abide by this Constitution and do his best to establish the Jama'at's organisation according to it.

(4) The President shall have the following powers:(a)Selection of his Working Committee from amongst the members of the Central Council.(b)Taking action with the consultation of members who could be approached for consultation in case when taking immediate action on important issues becomes necessary but the Central Council or the Working Committee could not be convened.(c)Appointment of Vice President(s) from amongst the Central Council or with the consultation of the Council.(d)Running of administrative affairs of the Jama'at, and use of the Jama'at's assets while observing the limitations, (if any), imposed in the interests of the Jama'at by the Central Council.(e)Admission of members in the Jama'at (Article 7) and their exclusion (Article 90).(f)Suspension or dissolution of any subordinate Jama'at. (Article 91).(g)Appointment or dismissal of subordinate Presidents, (Article 40, 54, 68, 84)(h)Appointment and dismissal of the Secretary General of the Jama'at and the staff of the Central Departments (Article 35, 36, 37).(i)Expenditure from the Jama'at's Fund (Bayt al-Maal) on the work of the Jama'at (Article 96).(j)Extension in the Central Council's tenure (Article 23)(k)Permission to anyone other than the members of the Central Council to attend its meeting (Article 27).(l)Ban the participation as observer or in the other status of non-members in a meeting of the Central Council (Article 26, 27)(m)Convening the General Assembly of the Jama'at (Article 16).

(n)Implementation of the Jama'at's decisions according to his discretion.(o)Delegation of some of his powers to another person.

3-The Central Council

Article 20: There shall be a Central Council, formed according to Article 21, to assist and advise the President, and its name shall be "Markazi Majlis-e-Shura" or "Majlis-e-Shura Jama'at-e-Islami Pakistan".

Article 20(a): At least three months ahead of the end of Central Council's tenure, the Election Commission would start arrangements for conducting the election of the new Council.

Article 21: (1)(a) The number of the elected members of the Central Council shall at least be 80, of which 70 shall be men and 10 women. Members on the male seats will be elected by the direct votes of men members and on female seats by the direct vote of women members.(b)Before an election, the Election Commission shall determine appropriate male and female constituencies by distributing their strength in proportion to the number of members from each province ensuring that each province has at least one seat.

(2)The President shall be the Chair of this Council and shall have the right of casting the tie- vote.

(3)(a)Secretary General of the Jama'at shall be ex-officio member and secretary of the Council.(b)Vice President(s), if any, shall be ex-officio members of the Council.(c)Provincial Presidents shall be ex-officio members of the Council.(d)Secretary Women wing will be ex-officio member of the council.

(4)If a seat falls vacant in the Central Council it shall be necessary to fill it within three month.

CompositionElection

(5)Directors of the Central Departments shall be eligible for attending and participating in the debates of the Central Council but shall not be entitled to vote unless they are elected members of the Central Council.

(6)Central Staff members shall be among the voters of the electoral constituencies within whose limits they live, but the Directors of the Central Departments shall be entitled only to vote and cannot be elected to the Central Council.

Composition and formationArticle 22: The President shall convene the inaugural session of the new Central Council within two months of the election of its members, where every member shall individually take the oath of office before the President in accordance with Appendix 2 of this constitution. Afterwards, the President shall apprise them about their duties and responsibilities as well as prevalent situation and state of affairs of the Jama’at.

TenureArticle 23: (a)The election of the members of the Central Council shall be for three years, but if the President, because of a change in situation facing the Jama’at or for a plausible reason,’ considers it necessary, he can, after consulting the Council, decide for fresh elections.

(c)If it is difficult to hold election of the Central Council owing to some extraordinary circumstances, the President shall be entitled to extend the tenure of the existing Council for a maximum period of one year, after consultation with the Provincial, Divisional, and District Presidents (that are available).

Ordinary SessionArticle 24: (1)The Central Council shall usually sit once a year for a session to be held, under normal circumstances, in the last quarter of the fiscal year. In this session, the report on the work of the Jama’at, the budget and the audit report of the Central Fund for the last year shall be presented; the work of the Jama’at during the past year shall be analysed and assessed, and the next year program shall be drawn up. This session of the Central Council shall be called an "Ordinary Session of the Council".

(2)The period between two ordinary sessions of the Council shall not exceed 15 months.

Extra Ordinary SessionArticle 25: (1)The President can summon an extraordinary session of the Council any time.

(2)Extraordinary session of the Central Council would necessarily be convened in the following conditions:

(a)When at least one-fourth of the members of the Central Council demand of the President for convening the session in writing, it is mandatory to hold a session of the council within 30 days.

(b)When the seat of the President falls vacant and there is no deputy, acting or temporarily appointed President the Central Department for Organizational Affairs of the Jama'at shall convene a session of the Central Council.

Participation of Jama'at members in the Central Council's Sessions as Observers

Article 26: Ordinary members of the Jama'at shall be entitled to attend the meetings of the Central Council as observers but the President may, in the interests of the Jama'at, revoke this permission for a particular session or part of it.

Participation of non-members in the Session

Article 27: If the President feels the necessity of inviting a person or persons other than the members of the Council to be part of consultation on some particular issue of the Jama'at, he may invite him/them to the session — but the issue can only be decided by the opinion of the members of the Council.

Quorum

Article 28: The quorum for the Central Council's session shall be one-third of the total number of its members. However, if a session is prorogued for lack of quorum, no quorum shall be required for the next session.¹

The Method for Reaching Decisions

Article 29: (1)In general, attempt will be made to decide all matters through consensus. But, in case of differences the decision of the majority of the members present in the session shall be considered to be the decision of the Council.

(2)If the President disagrees with the decision of the majority of the members of the Council (present), he may postpone it till the next session of the Council, but the decision arrived at in this (the next) session shall be final.

The same quorum shall apply to the subordinate councils.

Duties and responsibilities of the Central Council

Article 30:

(1)It shall be the duty of the Central Council collectively and of each member individually:(a)To give priority to obedience and loyalty to Allah and His Prophet over the rest.(b)To always keep an eye on the President and themselves to ensure adherence to the Jama'at's creed, commitment with its mission and observance of true Islamic mode of action.(c)To be regular in attending the meetings of the Council.(d)To forthrightly express their honest opinion on all issues according to their knowledge, faith, and conscience.(e)To desist from making permanent groups and blocs within the Jama'at, and should anyone be found so trying, efforts should be made to correct him instead of encouraging or showing indifference to him.(f)To try rectifying any fault in the Jama'at and its work whenever and wherever it is seen.

(2)The Central Council shall be vested with the following powers:(a)Formulating the Jama'at's policy.(b)Deposing the President provided that 2/3rd of the total elected members of the Central Council pass a no-confidence motion against him.(c)Interpretation and amendment of the Jama'at's Constitution, and making changes in the Jama'at's set-up.1

(d)Appointment of Secretary General of the Jama'at and presenting no-confidence resolution against him (Article 35).(e)Appointment of auditor for verification of the Central Fund, and deliberation and necessary action on its report (Article 96).(f)Approval of the central budget of the Jama'at (Article 24).(g)Authority to conduct above-board accountability of President and his subordinate directors of the Central Departments, to critically analyse and deliberate on their work.(h)Appointment of central and provincial parliamentary boards and determination of their scope of work.(i)Appointment of boards, committees, and commissions as required for work in different spheres and departments of the Jama'at and determination of their scope.(j)Convening the General Assembly of the Jama'at, and, when necessary, inviting delegates from amongst the members instead of the ordinary members (Article 16).(k)Giving expression to opinion through the passage of resolutions and other means, and taking other appropriate measures on issue arising within and without the country in connection with the Jama'at's mission, objectives and program.(l)Formulation and adoption of rules and regulations for the proceeding of the General Assembly and Central Council sessions.(m)Taking all necessary steps according to the Constitution for the realisation of Jama'at's mission.(n)Delegation of its powers, or some of them, along with the conditions that it wants to impose, to the Working Committee or any committee or board composed of its members, or to the President or the Secretary General or any other person or persons.

Dissolution of the Central CouncilArticle 31: If a President who had earlier been dismissed with a no-confidence motion of the Central Council is re-elected in the new elections, this shall be a no-confidence of the Jama'at on the Central Council and the Council shall stand dissolved on the day the President assumes charge of office by taking the oath. The elected President shall arrange for the election of a new Council and shall carry on his work in the meanwhile with the assistance and advice of an interim Working Committee composed of the Provincial Presidents.

Council of All District PresidentsArticle 32: If at any time the number of members capable of performing their duties falls short of even meeting the quorum required for the session of the Central Council, then a council of all District Presidents of the country shall be considered as alternative to the Central Council. This Council shall have the discretion of either working as the Central Council, or arrange for the formation of a new Council according to the Constitution, or devise some other appropriate and practicable formula for assistance and advice to the President keeping intact the spirit of the Constitution.

The procedure of calling the meeting of District PresidentsArticle 33: In the event of the President's office falling vacant, the power to convene the session of the Central Council shall vest, in order, in the Secretary General of the Jama'at, the Central Department for Organisational Affairs, every present member of the Central Council, and every District President.¹

4 - The Working Committee

Appointment, Status, and PowersArticle 34: (1)There shall be a Working Committee of Jama'at-e-Islami Pakistan, which shall consist of 16 members. These shall be selected by the President from amongst the members of the Central Council. The President shall be its Chair, Secretary General its ex-officio member and secretary, and Vice President(s), (if any), shall be its ex-officio member(s).

(2)Someone who ceases to be a member of the Central Council, shall also cease to be a member of the Working Committee.(3)The President can convene the session of the Working Committee whenever and as many times as he wants.(4)The quorum for the Working Committee session shall be ten, of which at least five shall be the non-ex-officio members.(5)A new Working Committee shall be formed after every new election of the Central Council.(5)During all such conditions when the Central Council is not in session or it is difficult to convene it, the Working Committee shall assume all the powers of the Central Council (except those of amending the Constitution and deposing the President). However, the Central Council shall have full power to ratify any of its decision or action, or disapprove it in part or in whole.

5 - The Secretary General

Article 35: (1)There shall be a Secretary General of Jama'at-e-Islami Pakistan who shall be selected by the President with the consultation of the Central Council.(2)Secretary General shall continue in office only as long as the President is satisfied with his work, but his dismissal shall be only with the consultation of the Central Council or the Working Committee.(3)The Central Council can dismiss the Secretary General through a no-confidence resolution, provided that, in case the President does not agree with it, the number of the members voting in favour of the no-confidence resolution shall not be less than half of the total number of members of the Council.(4)The Secretary General shall be the aide and representative of the President in all the affairs of the Jama'at. He shall perform duties and exercise powers that President shall assign him, and he shall be answerable to the President for his work.

(5)Before assuming the charge of office, Secretary General shall take before President the oath that is given in Appendix 3 of this Constitution.

Article 36: (1)The President shall be authorised to appoint one or more deputy secretaries general and distribute among them from the duties and powers of the Secretary General according to his discretion.(2)The status of the Deputy Secretary General whom the President may appoint as acting Secretary General in the absence of the Secretary General shall be the same as given to the Secretary General of the Jama’at in this Constitution.

6 - Directors of the Central Departments

Article 37: (1)Each Central Department shall be under a separate Directors appointed by the President according to his discretion.(2)The Directors of a Department shall continue in office only as long as the President is satisfied with his work.(3)The President shall determine duties and powers of the Department Heads.

7 - Election commission

Article 37(a): (1)There will be a five member election commission of the Jama'at e Islami Pakistan consisting of a chairman and four members to hold elections & preference polls.(2)The election commission will be formed by the central council in its 1st session after its own election. The chairman and the members of the election commission will take oath of their office according to appendix No.2A.(3)The election commission of the Jama’at e Islami Pakistan will hold the following election/ preference polls:

(a)Election for the President of JIP.(b)Election of the central council JIP.(c)Election of central working committee of JIP.(d)Preference poll for secretary general women wing JIP.(e)Election of the central council of women wing JIP.(f)Preference polls for provincial and provincial woman wing admin officers.

8-Election Tribunal

Article 37(b): (1) There will be five member election tribunal consistory of a chairman and four members to hear petitions concerning election and preference polls held by the election commission JIP.(2)The election tribunal shall be formed by the central council in its 1st session after its election.(3)The chairman of the election tribunal and its four members will take the oath of their offices according to appendix No.2(B)¹

Provincial Organisation 1 - Scope and Set-up

Article 38: (1)Pakistan may be divided into Organisational Provinces for the Jama'at's organisational requirements.(2)The provincial set-up shall comprise of the Provincial President, Provincial Council, and Provincial Secretary; unless the circumstances demand for some other set-up as a temporary arrangement.(3)Obedience of the Provincial set-up shall be binding on the Jama'at members of the province.

2 - The Provincial President

Article 39: A person shall be responsible for the Provincial set-up, to be called "Provincial President". His position in his province shall be that of a representative of the Central President, to whom he shall be answerable.

Appointment and Dismissal

Article 40: (1)The power to appoint and dismiss the Provincial President shall be with the Central President who shall give due consideration to the opinion of members from the province besides keeping in view the interests of the Jama'at.(2)The appointment for the office of the Provincial President shall be of three years.

The Oath

Article 41: Before taking charge of office, the Provincial President shall take oath before the Central President or a person or persons appointed by him, as given in Appendix 1 of this Constitution.

Duties and Powers of the Provincial President

Article 42: The duties of the Provincial President shall be as follows:

(1)Spread of the Jama’at’s Call, mission, policies and program in the province, and to take necessary steps for their realisation.(2)Carrying out Centre’s directives and arrange for timely payment of Central dues.(3)Keeping the Centre informed of conditions in the province and of the work of Jama’at in the province.(4)Supervision, guidance and accountability of the subordinate units, departments and institutions and their staff and workers in the province.(5)Taking timely notice and steps on issues pertaining to or affecting the mission and objective of the Jama’at in the province.(6)Execution of duties and responsibilities as may be additionally assigned by the Centre.Article 43 The Provincial President shall have following powers:(1)Appointment and dismissal of the Provincial Secretary in consultation with the Provincial Council.(1a)Selection of his Working Committee from amongst the members of the Provincial Council.(2)Appointment and dismissal of personnel in Provincial Departments.(3)Convening the sessions of Provincial Council and of Executive Committee.(4)Making expenditure from the Provincial Fund according to the budget approved by the Provincial Council, and take appropriate and necessary steps for performing his duties according to the Constitution.(5)Using in province the power that is vested in the Central President as per Article 19 (4b).(6)Exercise of additional powers that the Central President may delegate to him.

3 - Provincial Council

Composition and TenureArticle 44: (1)The Provincial Council shall be directly elected by the members in the province.(2)The Provincial President shall determine the number of the members to the Provincial Council. Before an election, the Provincial President or his appointed Election Supervisor shall determine appropriate constituencies by distributing this strength in proportion to the number of members in each constituency.(3)At least three months ahead of the Council's elections, the Provincial President shall appoint an Election Commissioner and vest him with powers required for conducting the elections.(4)Members of the Council shall be elected for two years.(5)The Provincial President shall be the Chair of the Provincial Council, and Provincial Secretary its ex-officio member and secretary.

Inaugural SessionArticle 45: The Provincial President shall convene the inaugural session of the new Council within two months of the election, where every member shall individually take the oath before the Provincial President in accordance with Appendix 2 of this constitution. Afterwards, the Provincial President shall apprise them about their duties and responsibilities as well as prevalent situation and state of affairs of the Jama'at in the Province.

Relationship between the Provincial President and the Provincial CouncilArticle 46: (1)Except for the day-to-day affairs, the Provincial President shall decide on all the important matters in consultation with the Provincial Council.(2)In case of discord between the Provincial President and his Council, the case shall be referred to the Central President.

The SessionArticle 47: The ordinary session of the Provincial Council shall be held once a year.Article 48: Extraordinary session of the Provincial Council may be convened any time under the following conditions:

(a)The Provincial President considers it necessary.(b)At least 1/4th of the Council members requisition it in writing, it is mandatory to hold a session of the council within 25 days.(c)The Provincial Department for Organisational Affairs, in case of absence of the Provincial President, finds it necessary.(d)The President orders holding its session.Article 49: The duties of the Provincial Council shall be as are stated in the oath of membership of the Council (Appendix 2), and the powers of the Council are as follows:(1)Giving expression to opinion through the passage of resolutions or statements on issues pertaining to and affecting the mission and objectives of the Jama'at, provided that they are not against any general or specific policy of the Centre.(2)Accountability of the performance of the Provincial Jama'at and subordinate units.(3)Approval of the provincial budget.(4)Adoption of confidence or no-confidence resolution for or against the Provincial President.

4 - Provincial Secretary GeneralArticle 50: The Provincial President shall appoint the Provincial Secretary in consultation with his Council who shall remain in office as long as the Provincial President is satisfied with his work.Article 51: (1)The Provincial Secretary shall be the aide and representative of the Provincial President in all matters of the Jama'at in his province, and shall execute the duties assigned to him by the Provincial President and shall be answerable to him.(2)Before taking charge of office, the Provincial Secretary shall take oath of office before the Provincial President as given in Appendix 3 of this Constitution.

5 - Provincial Working Committee

Article 51a: (1)There shall be a Working Committee of the Provincial Jama'at, which shall consist of maximum 10 members whom the Provincial President shall select from amongst the members of the Provincial Council. Provincial President shall be its Chair, Provincial Secretary its ex-officio member and secretary, and Vice President(s), if any, its ex-officio member(s).(2)Anyone who ceases to be a member of the Provincial Council, shall also cease to be a member of the Provincial Working Committee.(3)The Provincial President can convene the session of the Provincial Working Committee whenever and as many times as he deems necessary.(4)The quorum for the Provincial Working Committee session shall be half of the total number of its members.(5)A new Provincial Working Committee shall be formed after every new election of the Provincial Council.(6)During all such conditions when the Provincial Council is not in session or it is difficult to convene it, the Provincial Working Committee shall assume all the powers of the Provincial Council. However, the Provincial Council shall have full power to ratify any of its decision or action, or disapprove it in part or in whole.

6 - Directors of the Provincial Departments

Appointment, Dismissal, Duties and Powers

Article 51b:(1)Each Provincial Department shall normally be under a separate Head/Director appointed by the Provisional President according to his discretion.

(2)The Head of Department shall continue in office only as long as the Provisional President is satisfied with his work.

(3)Duties and powers of the Department Head shall be determined by the Provisional President.

Divisional Organisation 1 - Scope and Set-up

Article 52: (1)The President shall, on recommendations of the concerned Provincial Council, determine or bring changes in the Organisational Divisions of the Jama'at.

(2)The Divisional set-up shall comprise of the Divisional President, Divisional Council, and Divisional Secretary; unless the circumstances demand for some other set-up as a temporary arrangement.

(3)Obedience of the Divisional set-up shall be binding on the Jama'at members of the Division.

2 - Divisional President

Article 53: A person shall be responsible for the Divisional set-up, to be called "Divisional President". His position shall be of the representative of the Central President in his Division and he shall be answerable to the Presidents of higher set-ups.

Article 54: The Central President shall appoint or dismiss the Divisional President in consultation with the Provincial President; and in doing so shall give as much consideration as possible to the opinion of members from the Division besides keeping in view the interests of the Jama'at. The appointment of the Divisional President shall be for three years.

Article 55: Before taking charge of office, the Divisional President shall take oath before the Central President or a person or persons appointed by him, as given in Appendix I of this Constitution.

Article 56: (The duties of the Divisional President shall be as follows:(1)Spread of the Jama'at's Call, mission, policies and program in the Division, and to take necessary steps for their realisation.(2)Carrying out of directives of and arrange for timely payment of their dues.(3)Keeping the higher set-ups informed of condition in the Division and of the work of Jama'at in it.(4)Supervision, guidance and accountability of the subordinate units, departments and institutions and their staff and workers in the Division.(5)Taking timely notice and steps on issues pertaining to or affecting the mission and objective of the Jama'at in the Division.(6)Execution of duties and responsibilities as may be assigned by the higher set-ups.Article 57: The powers of the Divisional President shall be:(1)Appointment and dismissal of the Divisional Secretary in consultation with the Divisional Council.(2)Appointment and dismissal of personnel in Divisional Departments.(3)Convening the sessions of Divisional Council and meetings.(4)Making expenditure from the Divisional Fund according to the budget approved by the Divisional Council, and take appropriate and necessary steps for performing his duties according to the Constitution.(5)Exercise of powers that the Presidents of higher set-ups may delegate to him.

3 - Divisional Council

Article 58: (1)Every Divisional Council shall be elected directly by the Jama'at members of the Division.

Inaugural Session

Relationship between the Divisional President and the Divisional Council

The Session(2)The number of the members to the Divisional Council shall be determined by the Divisional President.

(3)The members of the Divisional Council shall be elected for two years.

(4)The Divisional President shall be the Chair and the Divisional Secretary ex-officio member and secretary of the Divisional Council.¹

Article 59: The Divisional President shall convene the inaugural session of the new Council within one month of the election, where every member shall individually take the oath before the Divisional President as given in Appendix 2 of this Constitution. Afterwards, the Divisional President shall apprise them about their duties and responsibilities as well as prevalent situation and state of affairs of the Jama'at in the Division.

Article 60: (1)Except for the day-to-day affairs, the Divisional President shall decide on all the important matters in consultation with the Divisional Council.

(2)In case of discord between the Divisional President and his Council, the case shall be referred to the Presidents of higher set-ups.

Article 61: There shall be two ordinary sessions of the Divisional Council in a year.

Article 62: Extraordinary session of the Divisional Council may be called any time under the following conditions:

(a)The Divisional President considers it necessary.

(b)At least three members of the Divisional Council requisition in writing.

(c)The Divisional Department for Organisational Affairs, in case of absence of the Divisional President, finds it necessary.(d)The Presidents of higher set-ups order to convene it.

Article 63: The duties of the Divisional Council shall be the same as are stated in the oath of membership of the Council, and the powers of this Council shall be as follows:(1)Giving expression to opinion through the passage of resolutions or statements on issues pertaining to and affecting the mission and objectives of the Jama'at, provided that they are not against any general or specific policy of the higher set-ups.(2)Accountability of the performance of the Divisional Jama'at and subordinate units.(3)Approval of the divisional budget.(4)Adoption of confidence or no-confidence resolution for or against the Divisional President.

4 - Divisional Secretary

Article 64: The Divisional President shall appoint the Divisional Secretary in consultation with his Council who shall remain in office as long as the Divisional President is satisfied with his work.

Article 65: (1)The Divisional Secretary shall be the aide and representative of the Divisional President in all matters of the Jama'at in his Division, and shall execute the duties assigned to him by the Divisional President and shall be answerable to him.(2)Before taking charge of office, the Divisional Secretary shall take oath of office before the divisional president as given in Appendix 3 of this Constitution.

Part VI

DistrictSystem

District Organisation

1 - Scope and Set-up

Article 66: (1) The Provincial President shall, in consultation with his Council, determine Organizational Districts of the Jama'at.

(2) The District set-up shall comprise of the District President, District Council, and District Secretary; unless the local circumstances demand for some other set-up as a temporary arrangement.

(3) District set-up shall be subordinate to the Divisional set-up, and shall keep contact with higher set-ups through it.

(4) Obedience to the District set-up shall be binding on the Jama'at members of the District.

2 - The District President

Position

Article 67: A person shall be responsible for the District set-up, to be called "District President". His position shall be of the representative of the Central President and he shall be answerable to the Presidents of higher set-ups.

Appointmentand Dismissal

Article 68: The Central President shall appoint or dismiss the District President in consultation with the Provincial and Divisional Presidents; and in doing so shall give as much consideration as possible to the opinion of members from the District besides keeping in view the interests of the Jama'at. The appointment of the District President shall be for two years.

Article 69: Before taking charge of office, the District President shall take oath before the Provincial President or a person or persons appointed by him, as given in Appendix I of this Constitution.Article 70: The District President shall be responsible for the whole set-up of the Jama’at in his District, and his duties and powers shall be basically same as those of the Divisional President in the Division. (Article 56, 57).

3 - District Council

Article 71: District Council shall be established only in those districts where there are at least 20 members of the Jama'at or the number of the subordinate units is not less than five; unless in the opinion of the Provincial President, the requirements of a particular district demand changing of this rule.Article 72: (1)District Councils shall be directly elected by the members of the district.(2)The number of members of the Council shall be determined by the District President.1(3)Members of the Council shall be elected for two years.Article 73: The District President shall be the Chair and the District Secretary ex-officio member and secretary of the District Council.2Article 74: The District President shall convene the inaugural session of the new District Council within one month of its election, where every member shall individually take the oath before the District President as given in Appendix 2 of this constitution. Article 76: District Council shall meet thrice a year for ordinary sessions.

Article 77: Extraordinary session of the District Council may be called any time under the following conditions:(a)District President considers it necessary.(b)At least two of the Council's members requisition it in writing.(c)The District Department for Organisational Affairs, in case of absence of the District President, finds it necessary.(d)Any President of a higher set-up orders to convene it.

Duties andPowers

Article 78: The duties and powers of the District Council and of its members in their district shall be the same as those of the Divisional Council and its members in their division. (Article 63)

4 - District Secretary

Appointmentand Dismissal

Article 79: (1)The District Secretary shall normally be appointed in such districts where there are District Councils. The District President shall make this appointment in consultation with his Council.(2)Before taking charge of office, the District Secretary shall take oath of office as given in Appendix 3 of this Constitution.(3)The District Secretary shall remain in office as long as the District President is satisfied with his work.

Duties

Article 80: The District Secretary shall be the aide and representative of the District President in all matters of the Jama'at in his District, and shall execute the duties assigned to him by the District President and shall be answerable to him.

Part VII

Local Organisation and Individual Members

Article 81: (1)A Local Unit shall be established where there are more than one members of the Jama' at.(2)Obedience of the Local set-up shall be binding on the members living within the boundaries of the Local Unit.(3)Each Local Unit shall be subordinate to the district, divisional and provincial set-up and shall keep contact with the Centre through them.(4)Where there is only one member in the Local Unit, he shall keep contact with the District President and shall work under his guidance and supervision.

Article 82: (1)Members of each Local Unit shall propose the most competent among them for Presidency and would get the approval of the Central President through the Presidents of their higher set-ups. This appointment shall be for one year.(2)Before taking charge of office, the Local President shall take oath in a meeting of the Local Unit, as given in Appendix I of this Constitution.

Article 83: If obtaining higher set-ups' approval is not possible at some time for some reason, the proposed person shall take oath of office anticipating the approval and shall assume the charge.

Article 84: (1)The position of the Local President in the Unit shall be that of the representative of the Central President, and he shall be answerable to higher set-ups' Presidents.(2)The Central President shall appoint or dismiss the Local President, and in doing so shall give as much consideration as possible to the opinion of members from the Unit besides that of the District, Divisional and Provincial set-ups.

Duties and Powers Local CouncilArticle 85: The duties and powers of the Local President within the Unit shall be fundamentally the same as those of the Divisional President in the Divisional set-up.(Articles 56, 57).Article 86: If a Local President deems it necessary, he may establish the Local Council in consultation with the members of the Unit. The term for a local council shall be two years.Article 87: The Protocol for the Local Council shall be fundamentally the same as has been prescribed for the District Council under Articles 72 to 78.

Part VIII

Organization of Women

Article 88: Women organization of the Jama'at will be separate from the setup of men members and associates.

(1)There shall be a Secretary of Women Wing of Jama'at-e-Islami Pakistan, whom the President of Jama'at-e- Islami Pakistan shall appoint for three years keeping in view the operation of women members of the Jama'at from all over the country, and she shall continue in office as long as the President is satisfied with her work and performance.

(2)The duties and powers of the Secretary of Women Wing shall be the same in the women's organization as those of the Secretary General under Article 35(4).

(2a)There will be ten seats of women in the central council of Jama'at e Islami Pakistan, which the women members will elect from amongst them, while the secretary women wing will be the ex-officio member of the central council.

(3)There shall be a Women Council to assist and advise the Secretary of Women Wing. It would have at most 25 members who shall be elected by women members of the Jama'at in proportion to the number of members in each province provided that each province, if there is a woman member, is represented by at least one woman representative.

(4) The council will be elected for three years.

(5) There will be a working committee of the women's circle which will consist of 8 members. These members will be selected by the Secretory Women Wing from among the members of the council.

(6)Appointment of provincial women head shall be for three years. Tenure for provincial women council shall be for two years. District head will be appointed for two years.¹(7)The Women Wing organizational setup will be established, in general, along the lines of male setup. Yet, if need for some alternate setup is felt at any place, it could be done by the women council with the approval of the President (Central).(8)Fund will be established at all levels of Women Wing (Central, Provincial, District, Local or Regional).(9)While conducting the audit and scrutiny of the fund, rules and regulations approved by the president will be adhered.(10)Each unit of the Women Wing shall work under the guidance of the corresponding set-up of the Jama'at.It would be maintained in general that the same woman is appointed on the position of secretary or head (Nazima) on a maximum of two consecutive terms, following that the responsibility is given to another woman. However, if the requirements of the Jama'at demand the woman who has served two terms as secretary or can once again be appointed for maximum two terms after an interval of one term. These are general policy lines, if alternate arrangement is not possible at some place the same woman could be repeatedly appointed as secretary or head (Nazima).

Dismissal from Positions in the Jama'at

1 - Dismissal of the Council's Members

Article 89: Any member of the Council (central or subordinate) shall be dismissed from the council, if he:(a)Ceases to be a member of the Jama'at-e-Islami Pakistan, or(b)Absents himself continuously from two sessions of his council without any valid reason, or(c)Resigns from council's membership and the concerned President accepts his resignation, or(d)The assembly of members from his constituency expresses no-confidence against him with at least 2/3rd majority.

2 - Expulsion from the Jama'at

Article 90: (1)Expulsion of a member of the Jama'at shall be possible only when he:(a)Deviates from his covenant of membership by word or by deed, or(b)Violates Jama'at's discipline, or(c)Does anything opposed to the announced policy of the Jama'at, or(d)Commits a deed that is damaging for Jama'at's moral and religious position, or

(e)It is evident from his attitude that his association with the Jama'at is not that of sincerity, or(f)Ceases to take interest in the Jama'at's work.

(2)If a District President feels himself or on the report of a subordinate President that a member of his district has violated any of the sub-clauses of the above Clause 1 to such an extent that he should be removed from the Jama'at's membership, he shall send his report through the higher set-ups' Presidents to the Central President.

(3)The final decision for expulsion shall be at the Central President's discretion. However, a Provincial or Divisional or District President may suspend the membership, if he deems it necessary, until the decision of the Central President.¹

3 - Dissolution and Suspension of Subordinate Units

Article 91: If Jama'at's stakes and interests so demand, the President is authorised to suspend a subordinate unit, and, in consultation with his Working Committee, dissolve it.

Article 92: All matters pertaining to suspension and dissolution of subordinate units or expulsion of members that may have taken place since the last session of the Council shall be presented before the Council in the next session.

4 - Limits of Disagreement in the Jama'at-e-Islami Pakistan

Article 93: Those members who remain steadfast in their covenant of adherence to the Jama'at's Constitution but whose view-point is different from Jama'at's decisions with regard to the strategies for the realisation of its mission, shall have to observe the following:

(1)They shall have full right to express their differences of opinion in an assembly of members, but they shall not be entitled to use the press or any public platform for this end, nor shall they have the right to canvass among individual members of the Jama’at.

(2)They shall accept the decisions arrived at by majority vote in the Jama’at as Jama’at’s decisions. However, they shall have the right to try to get those decisions changed in the relevant assembly of members, remaining within the determined limits.

(3)If a member expresses his difference with the established policy of the Jama’at, he shall no longer hold such a position in the Jama’at that demands implementation or interpretation of Jama’at’s policies.

Financial System 1 - Establishment of Fund (Bayt al-Maal)

Article 94: (1)A Local Fund for the Local Organisation, Regional Fund in the Region, District Fund in the District, Divisional Fund in the Division, Provincial Fund in the Province, and Central Fund in the Centre shall be established, unless the higher Council declares it unnecessary to establish a separate Fund for any set-up or considers it enough to have one Fund instead of separate Funds in a certain area.(2)All powers for the management of Funds shall vest in the President.

2 - Sources of Fund's Income

Article 95: The Income of Jama'at's Funds shall come from:(1)Jama'at's members and those interested in its work, through(a)Contributions(b)Zakat and Ushr(c)Charity (Sadaqaat)(2)Subordinate Funds(3)Profit from Jama'at's publications(4)Profit from Jama'at's bookshops

(5)Luqta (Lost & Found) (what is found in Jama'at offices and assemblies and which may be deposited in the Fund according to the rules of shari'ah)(6)Income from Jama'at's properties(7)Income from trusts' properties dedicated for the Jama'at

Explanation: Jama'at's members shall compulsorily deposit their Zakat, Ushr and obligatory charity in the Fund of Jama'at.

3 - Powers to Spend from Fund

Article 96:(1)Each Fund shall be under its President and the President shall have powers to spend from his Fund on any of Jama'at's work, but each President shall be answerable to his council and higher set-ups' Presidents.(2)The President shall be answerable to the Central Council for the income and expenditure in the Fund.(3)Audit of the Central Fund shall be conducted each year by an auditor appointed by the Council, and the auditor's report shall be presented before the Council.

Miscellaneous Criticism and Accountability, Making Rules and Regulations, Constitutional Amendment, Explanation of Terms 1 - Freedom for Criticism and Accountability

Article 97:(1)Each member of the Jama'at shall have the right to criticise and take into account the Central Organisation in the General Assembly, Provincial Organisation in the Provincial Assembly, Divisional Organisation in the Divisional Assembly, District Organisation in the District Assembly, and Local Organisation in the Local Assembly, subject to the condition that he shall not exceed the limits set by Shari'ah and or ethics and shall not adopt a manner that is damaging for the Jama'at.

(2)If a member has any objection to a decision taken by the President or the Council, or wants to ask about them, he shall have the right to:(a)Have it presented before the Central Council through any member of the Council' or(b)Present it personally at the General Assembly, subject to the condition that he shall forward his query or objection to the Secretary General within 10 days of the announcement for the General Assembly session.

(3)The powers for determining the method and procedure for criticism and accountability and raise objections and questions in the General Assembly shall vest in the Central Council.

2 - Powers to make Rules and Regulations

Article 98: The President in consultation with the Working Committee may formulate such rules and regulations as may be required for realising the purposes of this Constitution.

3 - Procedure for Constitutional Amendment

Article 99: (1)Only such proposal for Constitutional amendment shall be considered in the session of the Central Council that is included in its agenda, and for this a notice of fifteen days shall be necessary. The Central Council shall try to reach a consensual decision for the amendment as per the agenda; but in case of differences in opinion, the decision of a simple majority of total members of the Council shall be deemed as the decision of the Council.

(2)If a member of the Jama'at wants to make a proposal for amending the Constitution, he shall state this clearly and to the point in writing and forward it to the Secretary General at least 20 days before the commencement of the session of the Council. The proposal shall be included in the agenda after the approval of the President or the Working Committee or its appointed committee. However, the clear and to-the-point proposals sent by the Council members shall necessarily be included in the agenda, provided they reach the Secretary General at least 30 days before the commencement of the session.

4 - Explanation of Terms

Article 100: The terms used in this Constitution shall bear the meanings as given below, unless a term explicitly means differently in a particular context:

(1)'Jama'at and 'Jama'at-e-Islami' mean 'Jama'at-e-Islami Pakistan.'(2)'President' and 'Central President' mean 'President of Jama'at-e-Islami Pakistan'.

(3)'Permanent President' means the President elected under Article 17 by the members of the Jama'at.(4)'Interim President' means the President elected under Article 17 (6) by the members of the Central Council.(5)'Acting President' means the President appointed under Article 17 (7) by the Central President.(6)'Council' and 'Central Council' mean the Central Council of Jama'at-e-Islami Pakistan.(7)'Working Committee' and 'Central Working Committee' mean the Central Working Committee of Jama'at-e-Islami Pakistan.(8)'Subordinate Presidents' means Presidents of Provincial, Divisional, District, Regional, and Local set-ups of Jama'at-e-Islami Pakistan.(9)'Jama'at members' means, if the matter is about the Central set-up, members from all over Pakistan; if the matter is about a set-up of a subordinate unit, it means members from that area.(10a)'Organisational Province' and 'Province' shall be considered as synonyms and shall mean the area that the President declares organisational province of the Jama'at.(b)'Organisational Division' and 'Division' shall be considered as synonyms and shall mean the area that the President declares organisational division of the Jama'at.(11)'Organisational District' and 'District' shall be considered as synonyms and shall mean the area that the President declares organisational district of the Jama'at.(12) Local unit, local Jama'at and organizational unit will be considered synonyms and they should mean the territory which is declared as an organizational unit by the district council of jama'at.¹

(13) 'Central Department for Organisational Affairs' is the department that is functioning in the Centre of the Jama'at-e-Islami for the management of organisational issues.(14) 'Central Department' is that department which the President, the Working Committee or the Central Council declares as the central department. Appendix IV The Interpretations and Explanations of Different Articles by the Central Council

1-Interpretation Article 17(7)The temporarily vacated office of the President (President) can be filled with a temporary appointment. And the tenure of such an appointment shall be until the end of vacancy. As soon as the cause of vacancy is removed the temporary vacancy will be automatically filled. (September 1973)

2-Interpretation of Article 72At the time of election of a District Council, the total number of seats can be divided in Tehsils and elections can be held by creating Tehsil-wise constituencies. (November 1974)

3-Interpretation of Article 88The separation of women members’ setup from that of men members does not mean that women are deprived of the right to vote in the election of men members’ local unit, the right they were given in the light of the Central Council’s previous decisions. On the contrary, women members do have the right to vote in the Local President’s election. However, they will not be asked any questions if they do not exercise this right. (January 1978)

4-Explanation Article 90After issuing the orders of suspension of a member, the concerned President shall send the case, without delay, with necessary details, to the President for approval. If the President feels that there is not reason enough for suspension, or after investigation, the allegation against the member is proven wrong, the President shall restore his membership. (June 1954)

The procedure for expulsion from membership is that, a Local or a District President shall, before reporting the expulsion, issue a show-cause notice to the member in question, and if the explanation of that member is not acceptable, then the recommendation for expulsion can be sent to a higher set-up. The District President also has the power to suspend the membership, if he deems it necessary, along with forwarding his recommendation for expulsion. In general, to issue a show cause notice and obtain a response or explanation even before announcing a suspension seems fair. The suspension of a member should be for a period as brief as possible, and should not prolong beyond a reasonable limit. (January 1986) and December 2019)

The Procedure of Approval of the Resignation from Membership

If a member belonging to a Local unit, intends to resign from the (Jama'at) membership, he should tender his resignation to the President of the Local Unit, who shall forward it with his note to the President of the District, and the District President shall forward it with his recommendation to the Provincial President. The Provincial President has the power to accept or reject it. An appeal against this decision can be lodged with the President. A member who does not belong to any local unit, shall send his resignation to the District President who shall forward it with his recommendation for approval to the Provincial President. (January 1986)

The Procedure for the Reinstatement to Membership of an Expelled or Resigned Member

An application for reinstatement of a member, who had either resigned or was expelled, shall be approved by the President. The Provincial President too, like the District President, shall forward the application to the President of the Jama'at. (January 2003)

5-Explanation of Articles 40, 54, 68, and 82

Keeping in view the interests of the movement and the goals of preparation and training of alternate leadership, arrangements shall be made that generally, at local, zonal, district, divisional,¹ and provincial² levels, the appointment of a person as President should be for a maximum of two consecutive terms, and after that the office of the relevant President be given to some other appropriate member. However, if the party interests so demand, a person who has already completed two terms in office, can be, after a break of one tenure, appointed

President, for a maximum of two terms. These are the general lines of policy. However, if an alternate for the office of a President is not available at a place, then, with the permission of the Central President, there shall be room for giving the responsibility to the same person over and over again. 6– Explanation of Article 21 (2b)The Vice President/Presidents of a setup/level shall be considered ex-officio members of the Council of that level and shall also take oath of a Council Member. (December 1969)

7– Explanation of Articles 62(b) and 77(b)To requisition the sessions of the Divisional and District Councils, instead of 3 and 2 members respectively, one-fourth of their total members shall have to file a written demand. (December 1994)

Appendix 5 Evolutionary Stages of the Jama'at's Constitution

The very first version of the Constitution of Jama'at-e-Islami, was composed and unanimously approved by its 75 founder members, on the day of its formation dated 2 Sha'ban al-Mua'azzam 1360 AH (26 August 1941). It remained in force for entire eleven solar years, i.e., from 26 August 1941 to 26 August 1952.

As a result of the partition of India on 14 August 1947, the Jamaat e Islami of United India was also divided into these two separate parties: The Jama'at-e-Islami Pakistan and the Jama'at-e-Islami India. The Jama'at-e- Islami Pakistan, after partition, and especially, when Pakistan adopted the Objectives Resolution on 12 March 1949 and in principle became a Dar-ul-Islam, found its first constitution to be insufficient and in need of several amendments and additions in the light of changes circumstances and challenges. Therefore, the members of the Jama'at elected a "Constitution Reform Committee" in its All Pakistan General Convention, held from 10 to 13 November 1951, at Karachi, and entrusted it with the task of reorganizing the Constitution of the Jama'at. The Constitution compiled by this committee entered into force from 26th August, 1952.

Soon after its passage and enforcement, this Constitution required further revision and improvement. Despite the presence of the "Constitution Reform Committee", the review was delayed for many years. Firstly, the party was engaged in a countrywide campaign for the adoption of an Islamic Constitution by the Parliament. This engagement continued from 1952 to 1956. Secondly, the Military Court passed a death sentence against the Jama'at's founder and ameer Mawlana Syed Abul Aala Mawdui. Then on 11th May, 1953. Only two days later, the capital punishment was changed to life imprisonment. The Jama'at's Ameer was released as a result of Lahore High Court's decision of 28 April, 1955. The Constituent Assembly of Pakistan, eagerly responding to the popular demand, passed the constitution and decided to turn the country into the Islamic Republic of Pakistan. It was done on 29 February 1956. The new Constitution came into force on 23rd March, 1956. This Constitution comprises a preamble which includes the historic Objectives Resolution. It has been clearly written there that the Sovereignty belongs to Allah Alone, and the powers of the people of Pakistan, to be exercised within the limits

prescribed by Him, are a sacred trust. In addition, it included that no law repugnant to Islam shall be passed inthis country. The existing laws shall be changed according to the teachings of Qur'an and Sunnah.

This remarkable change in the country's Constitution and its collective system was partly a result of theJama'at-e-Islami's consistent struggle. The JI's message and organization expanded manifold. Reviewing thechallenges of its expansion, the JI called its All Pakistan Convention of Members from 16 to 20 Rajab al-Marjab1376 A.H, corresponding to (12 to 17 February, 1957). The “Constitution Reform Committee” was dissolved andthe following three resolutions were adopted regarding the amendments in the JI Constitution.

①The ever-increasing expansion of the Jama'at, the burden of work, the practical experiences so far, theorganisational and other needs require some changes in the Constitution. Hence this General Assembly ofMembers carries the following amendments.

(1) The ultimate responsibility to run the organization and the Islamic Movement shall lie with the President ofthe Jama'at; and he shall be answerable to the Central Council and the Members of the Jama'at.(2) The President shall formulate the Jama'at's policy and take decisions on important issues in consultationwith the Central Council.(3) The President shall have the power to select his Working Committee from among the members of theCentral Council on his own, and the Working Committee shall have powers that will be given to it in the newConstitution of the Jama'at.(4) If there is need to take an urgent step in important issues, and it is not possible to call a meeting of the CentralCouncil or the Working Committee, the President shall take that step by consulting, whomsoever he can,among the members of the Working Committee or the Central Council.(5) The President can appoint Vice President/s for his assistance; and they shall be able to perform the dutiesand use the powers assigned to them.(6) The number of members of the Central Council shall be not less than fifty. Before every election, this numbershall be divided in proportion to the number of members in different organizational constituencies. But everyconstituency shall have at least one seat.

(7) The members of the Jama'at can attend the Central Council's session as observers. However, the President, in the interests of the Jam'at, shall be able to cancel this permission for any special session.(8) If a no confidence motion against the President is supported by a two-thirds majority of the total elected members of the Central Council, the President shall stand ousted.(9) The Central Council shall have the powers to interpret and amend the Constitution.

②The members of the Jama'at, who are steadfast in their oath to abide by the Jama'at's Constitution, but who differ with the Jama'at in the practical ways of realizing the mission, shall have to observe the following code of conduct within the Jama'at.(1) They shall have all the right to express their difference of opinion at the Jama'at meetings, but shall not have the right to use the press and public platforms for this purpose; and they shall not do any whispering among the Jama'at's members individually.(2) They shall abide by the decisions reached by majority vote and accept them as the decisions of the Jama'at. However, they shall have the right to try to change those decisions within the set limits and in the relevant meetings.(3) If a member of the Jama'at has expressed his disagreement with the Jama'at's declared policy, he shall not be able to hold any position in the Jama'at which obliges him to enforce Jama'at's policy.

③This All Pakistan Members’ Convention of the Jama'at-e-Islami Pakistan declares that:(1) On the basis of the Resolution number 1 and number 2 (aforementioned), the Central Council to be elected {soon}, shall have to compile the Constitution anew.(2) The amendments sent for consideration to the Constitution Reform Committee elected in the general Assembly of 1955, be handed over to the new Central Council.(3) The election of the new Central Council should be completed before 31 March 1957.(4) The present Central Council shall exist until the election of the new Central Council.

Following the aforementioned decisions of the All Pakistan Members’ Convention, the election of the Central Council was held before 31 March, 1957. The first session of the Central Council was held at the residence of

Sardar Muhammad Khan Sahib, at Kot Sher Singh, District Lahore from 19 to 26 May, 1957. Forty-five out of the total 50 members of the Central Council participated in this session and the entire Constitution was approved with a consensus, except the clause 6 of article 34. Vote was held. Four members voted against, two abstained. This Constitution was approved on 25 Shawwal 1376 AH, corresponding to 26 May, 1957, and came into force from 12 Zil-Qa'adah 1376 AH, corresponding to 1st June 1957.

Within a year and a half of the enforcement of this Constitution, The Iskander Mirza and the Commander-in-Chief, General Muhammad Ayub Khan together imposed Martial Law in the country. The Constitution of the country was abrogated. The National and Provincial Assemblies were dissolved and the political parties banned. The Organisation of the Jama'at remained suspended for 3 years and nine months. After the constitutional system was established in June 1962, the political parties were restored under the Political Parties Act on 16 July, 1962, and the Jama'at resumed its activities the very next day.

The Jama'at's All Pakistan Convention was held at Lahore from 25 to 27 October 1963. According to the changing circumstances some amendments in the Constitution of the Jama'at were previewed in this convention. But, the improvident persons in positions of power in the province, banned the use of loudspeakers for this gathering of more than seven thousand permanent delegates, and thousands of others in the audience; and tried very shamelessly to disrupt and disturb the gathering through an armed gang of notorious goons of the city. A silencer fitted pistol was fired to hit the President during his opening speech. When this heinous attempt failed, the miscreants shot an innocent worker (Allah Bakhsh Shaheed) dead. This unhappy incident obliged a few changes in the convention schedule and the constitutional reforms in view could not be executed.

When these acts of cruelty and oppression utterly failed to quell and curb the Jamaat's advance, the government, under false accusations, declared the Jamaat unlawful on 6 January, 1964. The Jama'at's The , the Secretary General and the entire Central Council, a total of 54 leaders of the Jamaat were put in jail for an indefinite period, and all of the Jama'at offices in the country were sealed. However, the Supreme Court, declared this action against the Jamaat as illegal on 25 September, 1964. Immediately after this decision of the country's highest court, the Jama'at, by the grace of Allah, became active with greater vigor than ever before in the length and breadth of Pakistan.

On 9 October, 1964, the High Court approving a writ released all the 54 leaders of the Jama'at including the President. Following a decision of the Central Council, a provincial set-up of the Jama'at was established in East Pakistan, in October, 1963. After that, the need for the establishment of a similar provincial set-up in West Pakistan was also deeply felt, because there was no organisation for the provincial level works here. There was a need to amend the constitution for this purpose, and for other proposals coming also from members and the subordinate Jama'ats, for amendments. All these suggestions were handed over to a committee. This committee compiled them and presented them in a special session of the Central Council, held from 1st to 6th March, 1965. But due to other important issues before this session of the Council, the amendment work could not be done, and the Central Council decided that a special meeting of the Council be convened for the purpose at some time from June to December, and in the meantime more suggestions from the members (if there are any) should be sought. For this purpose, the appointed committee was re-constituted and it brought together all the new and old proposals from various members and subordinate Jamaats. After that the President called a special session of the Central Council in Lahore, on 17th September, 1965, to consider these proposals. But India suddenly invaded Pakistan on 6th September, 1965; a war broke out between the two countries, and this meeting had to be postponed.

Eventually, these amendments were presented at the annual session of the Central Council held at Lahore, from 8 to 14 December, 1965. After three days of deliberations and discussions, all the necessary amendments and additions in the Constitution were made unanimously. The most important of these amendments now make the fourth part of the new constitution, under which the details of the provincial system are stipulated and are made a part of the constitution. Apart from this, like the Central The, the tenure of all the subordinate The s has also been fixed. The casting vote for the President and the way to use it was also explained. The Secretary General was now to be a regular member of the Central Council, the Provincial President s and Secretaries were included in the Central Council as its ex-officio members. These amendments came into force from 1st Shawwal 1385 AH, corresponding to 24 January, 1966, and a new Constitution with all the amendments and additions incorporate was published in the same month (January 1966), as the fourth edition.1

Some amendments were also made in the Jama'at's Constitution on the occasion of the Central Council's session, held from 17 to 21 May, 1967. These are almost all of those whose need was felt during the implementation of the provincial system. The enforcement of these amendments was made from the date of their approval, that is, 21st May, 1976. The fifth edition of the Jama'at's Constitution was published with these amendments in November, 1969.1

The Divisional system was put to end in the Central Council's session held from 26 Jamadi-ul-Ukhra to 1st Rajab 1391, corresponding to 18 to 23 August, 1971.2 As a result, the question of constituencies arose. The Divisional circles, according to the Jama'at's Constitution, were also used to be the election constituencies of the Central Council. Also, after the establishment of provincial system of the Jama'at in all the five provinces, the ex-officio membership of the Central Council of Provincial Secretaries, in the eyes of some, became unnecessary. Since these amendments were of an administrative nature only, the Central Council formed a committee and commissioned it to consider and deliberate over these issues and propose necessary amendments in the Constitution and present them before the President. Moreover, the Central Council delegated its powers to the President to the extent

As the tenure of the subordinate Presidents was fixed under these amendments, so the Council decided in the same session that appointments of all Provincial Presidents, Divisional Presidents, District Presidents and Local Presidents should be made anew and their tenures should start together from 1 November 1966. Thus, the appointments to these offices shall always be from 1 November. The Council also decided that if the office of any subordinate president falls vacant before the end of the term, the new appointment shall be made for the remaining period of the tenure.

that he could approve the necessary amendments in the relevant articles in the light of recommendations madeby the committee formed by the Central Council. As a result, the President, in the light of these recommendations,amended articles 16, 21, 23(2), 30(2), 34(2) and 69. These amendments were enforced from the day they wereapproved, i.e. 15 Sha'ban 1391 AH corresponding 6 October 1971.

After this in January 1978, the Central Council approved amendments in article 58(4), and article 73. Here, itwas made explicit that the Secretary of a Division and the Secretary of a District will be ex-officio members andsecretaries of their relevant Councils.

In February 1982, the Central Council increased the number of Working Committee members from 12 to 15.

In its sessions of April and December 1987 the Central Council deliberated upon many an amendmentproposal and approved some changes of ordinary or literal nature in articles 12, 15, 19, 30, 31, 32, 33, 88 and 99.And lastly a new article was added in the Constitution in which the procedure of amending the Constitution isstated. Appendix 6 was also added.

In the Central Working Committee's meeting held on 6 June 2007, a Committee was assigned to suggest acomprehensive set of amendments in the Jamaat constitution, considering all 'the suggestions that came up fromtime to time based on the changing political and social conditions, and the expansion in the Jama'at's work andsetup. The committee completed its task in many sittings and proposed this package of amendments in theCentral Council's sessions held in December 2009, and June 2011. The Central Council approved, a total of 20amendments in these sessions. The most important of these amendments was about setting up of a Women'sCircle. Formerly, all the details regarding the Women's Circle were given in Appendix number 6 of theConstitution. However, after deletions and insertions made, these changes were included in Part VIII of theConstitution. On this occasion, apart from removing some printing errors and modifying diction, otheramendments were about Local President s and extension in the term of Local and District Councils.

At the time of approval of these amendments, it was decided that these would come into force from theJama'at's new organisational year (starting from the 1st of November, 2011). So, these amendments were to bekept in view during the election process which starts before 1st November.

By the end of 2013, the Planning Committee of the Jama'at was asked to consider measures for increasing the Jama'at's influence and spreading its message in the changing circumstances. The planning committee, after many individual and collective meetings with office bearers of various levels, prepared a document titled "Organizational Reforms". After long discussions and exchange of opinions, the Central Council in its session held from 30 April to 1st May, 2015, approved most of the proposals in this document. Some of these suggestions required amendments in the Constitution as well. Therefore, the Constitutional Affairs Committee, in its various meetings, compiled those amendments which seemed indispensable in the light of recommendations made by the Organisational Reform Committee.

As a result of keen deliberations, the Constitutional Affairs Committee composed a comprehensive amendment draft that was presented before the Central Council in its session of 3rd October 2015. This draft was unanimously approved. These amendments highlight the appointment of an Election Tribunal, the allocation of women seats in the Central Council and a selection of half of the members of the Central working Committee.

In the session of the central council(held 5-7 July, 2019) the committee was created to report on the appointment of provincial presidents, and women secretaries(Nazimat) of provinces, divisions, districts and local units, in the light of this report the president sanctioned a maximum of three terms for these appointments.

In the session of the Central Council of the Jama'at-e-Islami Pakistan held on 27 December, 2019 the recommendation of the constitution affairs committee were approved. Keeping these in view the sections of the Jama'at constitution 25(a), 48(b), 62(b), and 77(b) were amended, and upon the demand of the council members, the maximum duration for calling a meeting of the council was decided. In the same way section 90 of the Jama'at constitution was amended, and alongwith expulsion from membership, disciplinary action was also included as a punishment. Further the explanation 4 of the appendix 4 of the Jama'at constitution was also amended and in addition to expulsion from membership regarding the procedure of disciplinary suspension, an explanation and interpretation are stated.

In the session of the central council of the Jama'at-e-Islami Pakistan (held on 2-4 January 2021) by amending the sections of the Constitution of Jamaat-e-Islami Pakistan 37(A) and 37(B), the election commission and election tribunal of Jamaat-e-Islami Pakistan were constituted and their procedures, scope and powers were approved.

On June 3, 2021, a meeting of the central council was held, one of the sessions was held. One of the session s was held organizational fiscal and appointment of (subordinate) presidents of Jama’at. In this session, a committee formed for coordination presented its recommendation a result the tenure in performance report of setups under the district zone, tehsil and local unit) was changed.¹

In a session of the central working committee (held on 3 June 2021) rules for the president of JIP were approved. Further, the rules for elections and preference polls, written in Article 37 A, to hold elections and preference polls were also approved.

In the meeting of the central council of Jama'at e Islami Pakistan held on 25 to 27 June 2021 point 12 was amended and the words, local unit, local Jama'at / organization unit were defined as new.

New appointments will be made from Dec, 1.

Rules of the General Assembly On the occasion of All Pakistan General Convention

The members of the Jama’at-e-Islami Pakistan, if they have any objection against a decision of the Central set up, the President, the Central Council or the Working Committee, are fully authorized under Article 97 of this constitution, to resort to censure and accountability. There is only one condition. The limits of Shariah and morality must be observed. And no such manner be adopted which might harm the Jama’at. The Central Council has approved the following rules of conduct for General Assembly meetings under the same article of the Constitution of the Jama’at:

(1) The objections or the questions of the members should reach the Secretary General two weeks before the General Assembly.(2) The objections /questions regarding anything happening after the dates fixed for filing objections/questions and before the holding of Assembly session, should be filed in writing, at least two days before the Assembly session.(3) Suggestions shall not be presented because the time may be short and the number of members (complainants) may be large.(4) To avoid repetition, the questions and censures of the same nature shall be presented in combined form and the names of all the relevant members shall be read out.(5) The President shall have the power to allow one or more than one member to speak on a topic.(6) A member shall be allowed to speak for 5 to 7 minutes. During the session, the chair (President of the session) will determine the order in which the members will speak.(7) The President, or any of the Vice Presidents, the Secretary General or any office bearer in the Center whom the President asks, shall respond to an objection or a question.(8) The speech at the Assembly will be addressed to the President /Chair of the session, even if that speech or conversation is in response to another person. The President/Chair of the session shall have the power to interrupt a speaker and address the audience whenever he deems it necessary.

(9) Members are expected to know their position and responsibilities being a part of the Jama'at's most important institution, and shall refrain on their own, from the following:

(1) Using bitter words in speech or conversation, and using harsh words and tone while talking to other members or about them.(2) Censuring other colleagues unduly or ridiculing them.(3) Demonstrating anger and indignation.(4) Participate in the Assembly by making secret counsels in advance and adopting such behavior as can create divisions in the Jama'at.(5) Trying to obstruct instead of supporting the party work.

If a member commits any of the above-mentioned misdeeds, the President of the Assembly shall have the power (prerogative) to read out loud this Article of Rules before the whole assembly as a reminder or for obeyance. He can do this on his own or upon the request of another member.

Rules of Proceeding of Delegates’ Convention

Setting the Agenda

1. When the President decides to convene a Convention of Delegates, the Secretary General shall, inform delegates the date, time, period and place, formally in writing, through the District Presidents.2. The Secretary General shall set the agenda of this convention according to the instruction and guidance of the President.

Questions

3. If anyone of the delegates has any question, he should send his question in writing to the Secretary General, at least, ten days before the Convention. If any question arises later, such questions shall also be communicated to the Secretary-General in writing, on the first day of the Convention. Answers to the questions shall be given at the allocated time for them.

Suggestions and Pieces of Advice

4. Each suggestion shall be submitted in writing, clearly formulated and specified. The proponent shall be able to present his arguments in favour of it verbally. The verbal arguments can also be given in favour or disfavour of the suggestion. After giving a reasonable opportunity to discuss any suggestion, the President will conclude the discussion and, if deemed necessary, shall ask the delegates for voting to make a decision.

Criticism and Accountability

5. If the delegates have objection to the Jama’at’s central system or the decisions of the President or Council or the Working Committee, they shall be given full opportunity of criticism and accountability, provided that no delegate exceeds the limits of the Shariah and the ethical code and does not adopt any method that proves harmful to the Jama’at. The former traditions of the Jama’at and the necessary etiquettes of criticism and accountability shall be taken into account, in this regard.

Following the accountability by the delegates present at the Convention, those letters about the criticism and accountability, out of the letters received from the general members, shall, also, be presented in the Convention, and the concerned persons shall respond to them, too.

Alternate Presidents

6. The President shall nominate for the Delegates' Convention, one or more persons to preside the session in his absence.

Way of Discussion

7. Any matter that has come up for discussion once in the session, and decided, shall not be allowed again for discussion during the same session.8. Generally, to speak on any suggestion during the discussion, five to seven minutes shall be given to the proponent, and three to five minutes for those in favor or disfavor it, and three to five minutes shall be given to any speaker or delegate for criticism and accountability, also. This amount of time can be increased or decreased, according to the occasion in special circumstances.9. The speakers shall speak during the debate in the order that the President will set. The President shall have the power to stop the debate and discussion, and address himself at any time when he deems necessary, conclude the debate and instruct the delegates to finally decide the under-discussion suggestion, advice or resolution. If a matter cannot be decided unanimously, it shall be decided by a majority opinion.10. It shall be necessary that speeches and conversations related to the under-discussion topic in the session must be relevant to the topic, and there should not be repetition of those things that has already been presented by the speaker himself or any other speaker. The President shall have the power to stop the delegate from continuing speech, insisting on irrelevant conversation.11. Every delegate shall address the President in his speech and conversation in the session, even if his speech or conversation is in response to another delegate.12. The President's decision shall be final in matters not specified in these rules.

13. The delegates are expected to know their position and responsibilities being a part of the Jama'at's most important institution, and shall refrain on their own from the following.(1) Using bitter words in speech or conversation, and using harsh words and tone while talking to other members or about them.(2) Concerning other colleagues unduly or ridiculing them.(3) Leaving the meeting without the permission of the President or without his knowledge.(4) Demonstrating anger and indignation.(5) Participate in the assembly by making secret consents in advance and adopting such behavior as can create divisions in the Jama'at.(6) Trying to obstruct instead of supporting the party work.

If a member commits any of the above mentioned misdeeds the president of the Assembly shall have the power(prerogative) to read out loud this Article of rules before the whole assembly as a reminder or for obeyance. He can do this on his own or upon the request of another member.

Rules of Proceedings for the Central Council Meetings(unanimously approved by this Council in its session held on 20 May 1957, at Kot Sher Singh, District, Lahore)

Setting the Agenda1. When the President decides to convene the Central Council's session, the Secretary General shall inform the Council members formally in writing of the date, time, duration and venue of the session.2. The Secretary General shall set the agenda of the meeting according to the instruction and guidance of the President. The agenda will normally be issued, at least, fifteen days before the meeting. However, the President shall have the power to invoke the Council's session, in special circumstances, also on a notice of less than 15 days.3. If a member of the Jama'at likes a particular issue point to be included in the agenda, he shall send it to the Secretary General within ten days after the announcement of the meeting, in the form of a resolution, or any other specified and clear form in writing. It shall be included in the agenda if the President himself or a Committee appointed by the Working Committee approves its inclusion. However, the suggestions sent by the Central Council's members shall necessarily be included in the agenda provided that these are received within a stipulated time. If a proposal is made after the expiry of the time, the proposer shall have to explain those extraordinary reasons for which his proposal should be accepted.

Questions4. a- If a member of The Central Council intends to ask a question, he shall have to give to the Secretary General, at least, 5 days before the meeting. Except that any question has arisen after that, and the other questions arisen later, too, shall be given to the Secretary General in writing. The questions shall be presented in the session at the time allocated for them.b- The questions and objections of members of the Jama'at shall be presented before the Council only through a member of the Central Council.

The Alternate President4. The President shall nominate for every session of the Central Council, one or more persons from among the Council members, to preside the Council's sessions in his absence.

Setting up the matters to be discussed daily6. Usually, during the days the Central Council is in session, the matters to be discussed the next day shall be specified, so that the members come prepared.

Way of Discussion7. The President, or the Secretary General or any other person whom the President orders, shall present a point of discussion if it is included in the agenda by the Centre. If a point is included in the agenda by any member of the Central Council, the President shall ask him to present this issue.8. Anything that has been discussed in the Central Council once, and decided, shall not be discussed again, at the same session, unless a majority of the Central Council or the President himself deems it necessary.9. Usually, any person shall not be allowed to speak more than fifteen minutes during the discussion.10. Once a matter is tabled before the Central Council, no other matter can be presented until the first is decided, except when the Council decides, at any stage, to postpone the issue under discussion.11. The speakers shall take part in the debate in the order that the President will set. The President shall have the power to stop the debate and discussion, and address himself at any time when he deems it necessary.12. It shall be necessary in the speeches and conversations related to the under discussion topic in the session, that it must be relevant to the topic and there should not be repetition of those things that has already been presented by the speaker himself or any other speaker. In the event of its violation, other members shall have the right to divert the President's attention to it, and the President of the Council shall have the power to restrain the speaker from continuing his speech, if he insists on his irrelevant debate and discussion or repeats the arguments.13. During the meeting, every person in his speech or conversation shall address the President, even if he is responding to another member of the Council.

Way of Closing the Debate14. The President shall have the power to announce the closing of the discussion, on any issue, and instruct the Council to take a decision about it.

Observers15. The President shall have the power to ask the Jama'at Members, other than the members of the Central Council, who are present in the house as observes, to quit the meeting, at any time he likes.16. The observers shall not have the right to interfere with the proceedings of the house, under any circumstances, not even in the form of gestures.

Committees17. If any seat of a committee, from among the committees appointed by the Central Council, becomes vacant for some reason, or if a member of a committee is unable to serve in the committee, and the committee has not yet finished its work, and if this situation appears during the Central Council's session, the Council shall fill this seat itself; otherwise, the President shall have the power to fill it.18. The Central Council shall appoint itself the Presidents or Conveners for its appointed Committees, and if it does not, the President shall have the power to appoint them.19. A Committee shall submit its report in writing, to the Central Council, or its appointed person, or persons. If there is no such advice from the Central Council, the Committee shall submit its report to the President; and he shall take appropriate action on it.

Budget20. a- Prior to the presentation of the budget, the Jama'at's performance report, and the details of the revenue and expenditure, shall be presented before the Central Council, and after that the Director Finance, or the Secretary General, or in case of absence of both, any person appointed by the President, shall present the budget for the next year.

b- After presentation of the budget, the members of the Council shall be given one day, at least, for perusal and consideration, and they shall be allowed if they want to say something on it, and then the budget shall be presented section by section and get approved. But as a whole, the entire budget should be completed within three days.

c- If the Council wants, it can reduce, too, the period of one day for the perusal of budget and preliminary consideration.

Resolutions of No Confidence

21. a- Each resolution of no confidence shall be submitted to the Secretary General, in writing, and it shall bear the signature of the member or members of the Central Council, who are introducing it.

b- Each resolution of no confidence must reach to the Secretary General, at least seven days before the Central Council's session, unless the cause of no confidence has arisen after that, or the Council's session is convened at less than 15 days notice. In this second case, the Central Council shall decide how much time should be given to the person concerned to prepare his reply.

c- If the no confidence resolution is received during the session of the Central Council, it shall be presented within 24 hours after its reception, and if it is received in the days other than the session, it shall be presented to the Council within 24 hours of the commencement of the next session, unless its mover withdraws it.

d- On the presentation of the no confidence resolution before the Central Council, the debate on it in the case will begin if, at leaset, five of its members present, are in favor of bringing it under discussion, otherwise the move shall stand rejected by its own.

e- If the no confidence resolution is against the President, or any person who is presiding the session, the Council shall propose another person to preside for the discussion on this resolution. But, the person against whom this resolution is moved shall remain present in the session, so he can respond if he wishes.

f- The voting on the resolution of no confidence shall be by secret voting procedure.

Miscellaneous

22. The proposer of each resolution or motion shall be able to withdraw his proposal before the proposed voting, unless a number of one-third of the members present of the Council calls for a vote.23. If any item is not included in the agenda, but the President or the Central Council allows it to be presented, it shall also be brought under discussion during the session, and the President shall fix the appropriate time for it.24. The decision of the Council's President shall be final, regarding the matters not specified in these rules.25. Members are expected to know their position and responsibilities being a part of the Jama'at's most important institution, and shall refrain on their own, from the following: (1)Using bitter words in speech or conversation, and using harsh words and tone while talking to other members or about them. (2)Censuring other colleagues unduly or ridiculing them. (3)Demonstrating anger and indignation. (4)Leaving the session without taking permission from its president. (5)Participate in the Assembly by making secret counsels in advance and adopting such behavior as can create divisions in the Jama'at. (6)Trying to obstruct instead of supporting the party work.

If a member commits any of the above-mentioned misdeeds, the President of the Assembly shall have the power (prerogative ) to read out loud this Article of Rules before the whole assembly as a reminder or for obeyance. He can do this on his own or upon the request of another member.

Note: These rules were approved on 20 May, 1957, at 5pm, and enforced immediately.

Rules Election of the President of the Jama'at-e-Islami Pakistan

1. The election commission shall commence the election process for the new election, three months before the end of the office tenure of the president JIP and shall have the power to appoint assistants as the need.2. The election commission shall appoint territorial assistants (provincial, regional and district). The election commissioner will be responsible for announcing the election schedule, preparation of ballots papers and provision to the territorial election assistants (provincial, regional and district). The territorial election assistants will be responsible for the provision and collection of ballot papers. And there will just after the last date of election send ballot papers to the election commissioner. Counting will be the responsibility of the election commission and the results will be announced formally by the election commissioner.3. The central office of the Jama'at shall provide to the election commission a complete list of the members of the Jama'at at least 60 days before the end of the president's tenure of office.4. The right to vote will be given to the members of the Jama'at who have taken their membership oath 90 days by the election. The members taking oath after this election will not have the right to vote.5. All of the voters will be duly allotted serial number in the list and the same serial number will be considered as their voter number.6. The central council will suggest three names for the guidance of the members in the election of the president. These three names will be elected under supervision of the election commission through secret ballot on the bases of majority. And those will be printed on the ballot paper in alphabetical order and provided to the voters through the members of the Jama'at can cast their votes in favor of any member other them the said three.7. To meet the requirements of secret ballot the name of the voter or their number and address will not be printed on the inner envelop. Yet the outer envelope will carry the serial number so that at the time of receiving the voter number on the list could be sure matched with the serial number on the envelop, at the time of counting inner envelops will be opened as the same time and ballots will be separated and after that counted.

8. The person getting most votes in the counting will be elected.9. In the election of the president if equal votes are cast in favor of more than one persons the central councils will elect any one of them through a secret ballot.10. Election petition can be filed within 30 days after the announcement of the election results.11. Any voter can file a petition in the Jama'at's tribunal after the announcement of the election. The tribunal shall give its decision on any petition within ninety days of its receipt.12. After the count an election chart and record of the cast ballots will remain in the custody of the election commission. Nobody will have access to this record except the election commission. Yet in case of a petition Election tribunal will have the necessary access to the record.(Approved in the working committee meeting held on June 3, 2021).

Rules The Election of the Central Council Pakistan

1. The election commission of Jama'at-e-Islami Pakistan will conduct elections and preferential polls according to the rules derived from article 31A of the JI's constitution.2. The election commission of a territory (provisional, regional and district etc.) will appoint election assistants to assist in the holding of elections / preferential polls. The chairman of the election commission will be responsible for the announcement of election schedule, preparation of ballot papers and their provision to the territorial assistants of election / preferential poles. The territorial (provincial, regional or districts) election assistants / preferential pole assistants will be responsible for the delivery and collection of ballot papers from the members of Jama'at and they will send these (marked) ballot papers to the chairman of the election commission immediately after the last day of voting. The election commission will be responsible for the counting of the votes. The results of the elections will be duely announced by the chairman of election commission and will send complete results of the preferential poles to the president.3. The territorial commission of election / preferential will prepare the list of members of Jama'at with the help of the district setup and will apprise the election commission number of voters in writing sixty days before the election. The list will be available for the guidance of the members of the Jama'at in the district offices.4. Only those members of the Jama'at will be eligible to vote who have taken oath of membership sixty days before the election.5. All the voters will be allotted serial number in an order and the same serial number will be considered their voter number.6. To meet the requirements of secret ballet the name of the voter or their number and address will not be printed on the inner envelop. Yet the outer envelope will carry the serial number so that at the time of receiving the voter number on the list could be sure matched with the serial number on the envelop, at the

time of counting inner envelops will be opened as the same time and ballots will be separated and after that counted.

7. In case of elections the person will be considered elected who bags most of the votes. If more when one person's get an equal number of votes, the decision of the election will be made on the basis of the toss.8. In case of a preferential poll the complete results after counting will be sent to the president.9. Any voter may file a petition in the election tribunal within thirty days of the announcement of the election results.10. The election tribunal will dispose of any petition within ninety days of its receipt.11. After the counting in every election, the election chart and the record of the polled ballot papers will be kept in a safe custody of the commission. Nobody will have access to this record accept the president and the election commission although in case of a petition, the election tribunal will have the necessary access to this record.

Invoke Allah, the Lord of the entire Universe, as witness, and do affirm that:

(1) I have fully understood the creed of the Jama'at-e-Islami Pakistan along with that explanation, stated in Article 3 of the Constitution of the Jama'at-e-Islami Pakistan, and having understood it I bear witness with a sense of responsibility that there is no God save Allah and Muhammad (May Allah's blessings be on him) is His Prophet.

(2) I have also fully understood the mission of Jama'at-e-Islami Pakistan along with its explanation, as stated in Article 4 of the Constitution of Jama'at-e-Islami Pakistan, and having understood it, I declare that the establishment of Allah's Deen (Divine Order) is the mission of my life, and that I am joining the Jama'at-e-Islami purely for Allah's sake to struggle for the realization of this mission, and that I have no motive other than seeking Allah's pleasure and the success in the Hereafter.

(3) I have also fully understood the Jama'at's Constitution, and I promise that I shall fully adhere to the Jama'at's system in accordance with this Constitution.
